Maybe criminal lawyers already know the answer to this, but neither I nor the judge knows. Can US Marshalls assigned to supervise a person out on bail shoot him if he attempts to escape?
According to the New York Daily News (ht: ABA Law Journal), U.S. District Judge Jed Rakoff “asked prosecutors and Dreier’s lawyers to research the issue before he decides whether to free Dreier on bail with 24-hour armed security.”
If I were Dreier, I’d pay for that research myself. That information would play a very important role in my plans.
