Scammer Used BigLaw Imprimatur

by law shucks on March 19, 2009

whodunnitAlbert Hu was arrested in Hong Kong on SEC charges that he had bilked Silicon Valley investors out of approximately $5 million.  Hu ran an investment fund, Asenqua Ventures, that “invests in companies that are creating the technology behind the next generation of digital lifestyle products and services.”

In addition to the usual shenanigans of claiming his companies’ books had been audited and making up, and signing documents on behalf of, a fake CEO, Hu went the extra mile.  He claimed various major law firms were advising on the transactions.  The firms, their response, and Hu’s alleged contacts in the government, after the break.

Among the firms’ names he used were Pillsbury Winthrop Shaw Pittman, “Heller Ehrman Rose” [sic], Proskauer Rose, and “Kirkpatrick & Lockhart” (now K&L Gates).

All have denied any involvement in Hu’s activities, but there are some connections:

According to the Reporter,

Lucas Chang, a Palo Alto, Calif., partner at Morgan, Lewis & Bockius, wrote that as a partner at Heller Ehrman, he’d represented Hu’s Asenqua Capital in 2002 or 2003. But Chang wrote that he didn’t give advice on preparing the documents where Hu listed Heller Ehrman. Chang was in Beijing and couldn’t be reached for comment.

Chang (National Taiwan University BSE ’77, Washington PhD (Chemical Eng.) ’83, Santa Clara JD ’94) is MLB’s senior partner of the Greater China Practice.

K&L Gates was also not involved but did have some tangential relationships with Hu.  According to Jeffrey Maletta (Harvard BA ’75, Stanford JD ’79), a securities-enforcement partner in the firm’s DC office, “the firm had given unrelated legal advice to Hu and some of his funds — and noted that the attorneys who did the work are no longer with the firm.”

Hu’s bio claims that he has advised the DOJ “on the monopoly issues in the semiconductor capital equipment industry” and served as an expert witness in an International Trade Committee review of an international DRAM dispute.  Hopefully he made some friends who can help him out.

The SEC release is here and the complaint is here.

MADOFF + STANFORD + DREIER + SATYAM + ALBERT HU = PROSKAUER ROSE
Investors who have been burned in these scams should start to seek redress from the lawyers who were involved with these scams.
Did I hear Proskauer Rose is involved in Madoff (involved many clients too) and acted as Allen Stanford's attorney. Investors who lost money in this scams should start looking at the law firm Proskauer's assets for recovery. First, Proskauer partner Gregg Mashberg claims Madoff is a financial 9/11 for their clients, if they directed you to Madoff sue them. Then, Proskauer partner Thomas Sjoblom former enforcement dude for SEC and Allen Stanford attorney, declares PARTY IS OVER to Stanford employees and advises them to PRAY, this two days before SEC hearings. Then at hearings he lies with Holt to SEC saying she only prepared with him but fails to mention Miami meeting at airport hanger. Then Sjoblom resigns after SEC begins investigation and sends note to SEC disaffirming all statements made by he and Proskauer, his butt on fire. If you were burned in Stanford sue Proskauer.
