* UBS and the IRS have reportedly (again) settled the tax-evasion case. We’re still asking, did Wachtell (and Cravath) get the bank a good deal? The bank agreed to pay $780 million to settle the criminal charges and thought they’d be able to keep the names private, but now at least some of the people will be identified for investigation by the IRS. Pillsbury represented the Swiss government.

* McKool Smith won a $290 million judgment (including damages and interest) from Microsoft. The software giant infringed their client’s patents relating to XML. Weil Gotshal represented Microsoft. [HT: Groklaw]
* What ever happened to “judicial notice”? Maybe a recent bartaker can remind us, but isn’t the court supposed to be aware of certain obvious facts? So how is it that a class-action judge didn’t know Bill Lerach was involved in the plaintiff-kickback mess? He was shocked (shocked!) to find out and lopped $45 million off his former firm’s fees.
* Blank Rome is paying $20 million to settle a malpractice suit.
